IT and ITeS Policy of Uttar Pradesh 2022 - Fiscal Incentives for New Units - Patent Filing Cost
The IT & ITeS Policy of Uttar Pradesh 2022 is a state policy of the Government of Uttar Pradesh, to promote investment, jobs and innovation in IT and IT-enabled services in the state. It is operated through Invest UP / Department of IT & Electronics / UPLC. The policy period is five years. Among its fiscal incentives, it clearly provides a one-time reimbursement of patent filing cost to IT/ITeS units situated in Uttar Pradesh so that MSMEs and startups can protect their innovations without bearing the full cost.
Key Features
- 100% reimbursement of actual cost – the state will reimburse the actual amount you spent on filing the patent (official fee + professional/agent fee, as admissible), not just a percentage, but subject to the ceiling mentioned below.
- Granted patents only – the wording says “on awarded patents,” so mere filing is not enough; you must submit proof that the patent has been granted.
- Two different caps – for patents granted in India the maximum payable is ₹ 5 lakh; for patents granted abroad the maximum payable is ₹ 10 lakh.
- One-time – the portal explicitly tags this incentive as “one-time,” so the unit should plan to claim it once per the scheme’s rules (if you have multiple patents, you should check the nodal agency for how they treat multiple awards under the one-time tag).
- UP-based IT/ITeS unit – the incentive is part of the IT & ITeS Policy 2022, so the beneficiary must be an IT/ITeS unit operating/located in Uttar Pradesh and registered under the policy.

Who Can Apply:
- Registered IT and ITeS units operating within Uttar Pradesh.
- Startups and MSMEs recognized under Startup UP or Udyam engaged in technology, software, or IT-enabled services.
- Units that have been granted (awarded) patents in India or abroad for innovations developed by them.
- Entities that have clean records such as no government dues or legal defaults.
Who Cannot Apply:
- Units located outside Uttar Pradesh or not registered under the State’s IT & ITeS Policy.
- Firms with pending or ungranted patents (only awarded patents qualify).
- Companies that have already received reimbursement for the same patent under another scheme.
- Entities blacklisted or in loan default with any bank or government agency.
- Applicants without valid business or tax registrations.
