The Uttar Pradesh Startup Policy 2020, notified by the Department of IT & Electronics, Government of Uttar Pradesh and implemented via Uttar Pradesh Electronics Corporation Ltd. (UPLC) as the nodal agency, aims to nurture and scale up startups in the state over a five-year period. One of the key fiscal incentives under this policy is the Patent Filing Cost Reimbursement, which helps eligible incubated startups defray the cost of successfully obtaining patents (both domestic & international) thereby encouraging innovation, IP protection and technology-led growth in the state
Key Features
- Reimbursement of filing cost for awarded patents: The incentive covers the cost you incur when your startup successfully gets a patent granted. It does not just cover filing, but more specifically “successful patent” (i.e., awarded). This ensures startups are motivated to carry innovations to grant stage.
- ₹ 2 Lakh for Indian patents: If your startup obtains a patent in India (Indian Patent Office grant), you can claim reimbursement of up to ₹ 2 Lakh for the cost of filing that patent.
- ₹ 10 Lakh for International patents: If your startup obtains a patent overseas (international jurisdiction) and it is awarded/granted, you can claim up to ₹ 10 Lakh for the filing cost as reimbursement.
- Restricted to incubated startups: The policy clause mentions “incubated startups” for this incentive, meaning your startup must be incubated under a recognized incubator which is approved under the policy or nodal agency.
- Indian + foreign awarded patents covered: The policy phrasing states that both Indian and foreign patents are eligible under this line of fiscal support, making it favourable for startups aiming for global IP protection.
- Additional inclusive incentives: If your startup has a woman / transgender / divyangjan co-founder with more than 26% equity, or if you are operating in Purvanchal / Bundelkhand region or are from EWS category, you may get additional 50% incentive on certain base benefits (including this one, depending on policy interpretation).

Who Can Apply:
- A startup incorporated in Uttar Pradesh and registered under the national Startup India programme.
- The startup must have a patent filed and awarded in its name (either Indian or international) and the cost of filing must have been incurred.
- The startup should be incubated in a recognised incubator under the UP policy (for this particular incentive, the policy mentions “incubated startups”).
Who Cannot Apply:
- Startups not incorporated in Uttar Pradesh.
- Startups that are not registered with Startup India or do not meet the policy’s definition of a “startup”.
- Patents that are not yet awarded, or the filing cost was not incurred by the startup itself.
- Startups that have already claimed this specific reimbursement for the same patent under another scheme (duplication of claims).
- Applicants who do not meet incubation or policy registration requirements.
Documents Required
- Certificate of Incorporation of the startup (registered in Uttar Pradesh).
- Startup India registration certificate.
- Incubator certificate (if required) proving the startup is incubated under a recognised incubator.
- Patent award certificate (Indian or International).
- Invoice/receipt showing cost incurred for patent filing.
- Bank statement showing payment of filing cost.
- GST/PAN details of the startup.

Option 2: Apply via StartInUP Portal
- Visit the official portal of the UP Startup Policy on StartInUP.
- Log in with your startup registration details (incorporated in UP, Startup India registered).
- Navigate to the “Incentives” section → “Patent Filing Cost Reimbursement”.
- Fill in the application, attach: award certificate of patent, invoice/receipt of filing cost, startup registration, incubator certificate (if required).
- Submit for verification; upon approval the reimbursement will be credited to the startup’s bank account.
Option 3: Apply via Recognised Incubator
- If your startup is incubated in a GOUP-recognised incubator, you may apply via that incubator’s portal or seek assistance.
- The incubator forwards your claim to the Policy Implementation Unit (PIU) of the state.
- On approval, the amount is disbursed to the startup’s registered bank account.
